Accident Caused by a Defective Truck

In every truck accident case we take on, we look at the wreckage (the truck and all vehicles involved in the accident) and determine if a defective part caused the accident.  If a defective part in the truck caused the accident, the manufacturer of the part is liable.  This means the manufacturer of the defective part is legally responsible to compensate the accident victims and their families, at least in part.

Even when if a defective part was involved in an accident, the trucking company, the driver and others are usually also liable.  It is in the victim’s interest to have as many liable parties as possible.

Common truck defects include:

  • The slack adjusters may fail as a result of a fatigue crack, rendering the slack adjuster inoperative;
  • A misprinted label could lead to improper vehicle loading specifications or tire inflation which could result in a tire failure, increasing the risk of a crash;
  • The pivot pin was manufactured out of specification resulting in a reduction of fatigue strength of the pivot pins, which could cause the pivot pin to crack and eventually break, causing the trailer to detach from the truck while in motion;
  • The incorrect or defective brake components were installed–air brake system, hydraulic brake system, electric service brake system, emergency brake system, or parking brake system;
  • The steering gears contain incorrect or defective parts (sector shafts,   gear tooth, rack-piston teeth), resulting in a steering gear stall and restricted turning ability.
  • Axle assemblies may have been produced with a thin spindle nut or other defective part, leading to a truck wheel separation and the “run away” wheel causing an accident.

Amputation and Decapitation

Many accident-related amputations are caused by tractor trailers and other large trucks.  When a vehicle of massive size and weight collides with a car, motorcycle, bicycle or other vehicle, bones get crushed.  Almost all of the traffic-accident-related decapitations happen when a car hits a tractor trailer or other big truck.

If an accident or trauma results in complete amputation (the body part is totally severed), the part sometimes can be reattached, especially when proper care is taken of the severed part and stump.

In a partial amputation, some soft-tissue connection remains. Depending on the severity of the injury, the partially severed extremity may or may not be able to be reattached.

There are various complications associated with amputation of a body part. The most important of these are bleeding, shock, and infection.

Spinal Cord Injury (SCI)

Spinal cord injuries can result in paralysis.  Paraplegia is a  form of paralysis affecting the lower half of the body, in which both legs, and perhaps also some of the muscles of the bladder and rectum, are paralyzed.  Quadriplegia or tetraplegia is paralysis of all four extremities. It includes the trunk and sometimes the neck. With both paraplegia and quadriplegia, paralysis of each extremity may be complete or partial.
