Motorcycle Rear Ended By Minivan, Car or Truck

A high percentage of rear end collisions occur due to a form of negligence, not fulfilling the duty of care to drive safely. Types of negligence include: texting while driving, talking on a cellphone, reading, changing the CD or radio station, and drunk driving.

If your loved one was killed in a rear end collision, you may file wrongful death claims against all liable parties. This can include the driver of a vehicle, the owner of a vehicle, a bar that served a drunk driver and others.

There are four key elements of driver negligence:

  • Duty of care
  • Breach of Duty
  • Direct or Proximate Cause
  • Injury

Each of the these elements has to be proven. Minnesota auto accident attorney Fred Pritzker has more than 30 years of successfully litigating Minnesota auto accident and wrongful death cases. He and his team know how to gather evidence and use it effectively for successful settlement negotiations.

fatal motorcycle accidentSeveral tragic motorcycle deaths occurred in Minnesota and Wisconsin over the third weekend in April. One involved an Oakdale, Minnesota woman killed Saturday in Oak Grove, Wisconsin. She was a passenger on the motorcycle and her husband, who was operating the vehicle, was injured severely enough that he had to be airlifted to Regions Hospital. The collision occurred near the intersection of Highway 35 and County Road E, when a car driven by a River Falls, Wisconsin woman pulled into oncoming traffic and struck the motorcycle. Both motorcycle passengers were thrown from the vehicle.
