Our law firm, located in Minneapolis, MN, recently resolved a truck case in which we represented a husband and wife whose auto was hit by a semi truck on a Minnesota highway. When we initially got the case, we were not sure who was at fault, so we began an investigation. We hired an accident reconstruction expert to piece together the forensic evidence at the scene:

  • Skid marks
  • Tire treads
  • Damage on vehicles

Our expert was able to determine that the truck that had sideswiped our clients’ auto, causing it to spin out of control, go through the median and hit another vehicle head on.  We then hired an animationist to do an animation of the accident.  With this evidence, we were able to demonstrate how the accident occurred, and we won over $2,000,000 for our clients.

T-Boned by Semi: Truck Accident Attorney

T-boned by a semi truckWhen a vehicle is t-boned by a semi, it usually involves negligence due to failure to yield the right-of-way. This can happen at an intersection controlled by a signal light or stop sign or an uncontrolled intersection. The Minnesota State Statute pertaining to yielding right-of-way at an uncontrolled intersection and for left turns reads as follows:

169.20 RIGHT-OF-WAY.
Subdivision 1.Approaching intersection.

(a) When two vehicles enter an uncontrolled intersection from different highways at approximately the same time, the driver of the vehicle on the left shall yield the right-of-way to the vehicle on the right.

(b) When two vehicles enter an intersection controlled by stop signs or by blinking red traffic signals requiring drivers or vehicles from any direction to stop before proceeding, the driver of the vehicle on the left shall yield the right-of-way to the vehicle on the right.

(c) At an uncontrolled approach to a T-shaped intersection, the driver required to turn shall yield to the cross traffic.

(d) The driver of any vehicle traveling at an unlawful speed shall forfeit any right-of-way which the driver might otherwise have hereunder.

(e) The foregoing rules are modified as hereinafter stated in this section.

Subd. 2.Left turn.

The driver of a vehicle intending to turn to the left within an intersection or into an alley, private road, or driveway shall yield the right-of-way to any vehicle approaching from the opposite direction which is within the intersection or so close thereto as to constitute an immediate hazard.

A speeding semi truck driver forfeits right-of-way. For example, if a vehicle runs a stop sign and a semi truck speeds through the intersection and t-bones the vehicle, both drivers are at fault. Any passenger injured in the accident can sue both drivers.

Compensation for T-Boned by a Semi Truck

Compensation for being t-boned by a semi truck may include:

  • current medical expenses
  • future medical expenses
  • lost wages
  • physical therapy
  • pain and suffering

Pain and suffering is a broad category that includes compensation for physical pain, emotional distress, disfigurement, disability, loss of quality of life and embarrassment.
